Californians to Get $50 Million Slice of Ameriquest Settlement

LOS ANGELES—The parent of Ameriquest Mortgage Co. will pay up to $50 million in restitution for California borrowers as part of a settlement brokered with state attorneys general over claims of deceptive lending practices, a prosecutor said Tuesday.

Some 725,000 borrowers in 49 states will be eligible to recover part of their losses through the $325 million settlement agreement.

“California is getting by far the largest share,” said Tom Papageorge, a deputy district attorney in Los Angeles County. “We had about 22 percent of all Ameriquest loans by volume of dollars.”

A judge finalized the settlement amount on Tuesday, he said.

The settlement applies to Ameriquest customers who took out loans between 1999 and 2005. It covers ACC Capital Holdings Corp., Ameriquest Mortgage Co.’s holding company, and also applies to subsidiaries Town & Country Credit Corp. and AMC Mortgage Services Inc., formerly Bedford Home Loans.

Borrowers who decide not to opt for the settlement or who have already pursued separate litigation will not be eligible for restitution under the state agreement, Papageorge said.

Ameriquest is expected to split its payments to the states into four installments. As a result, qualified borrowers in California aren’t expected to see any money before next year.

Ameriquest customers who took out loans between Jan. 1, 1999, and April 1, 2003 could get a minimum of around $600. The state hasn’t determined how much money borrowers who fall outside that period will get.

The state will hire an outside firm to handle the payments, Papageorge said.

Ameriquest, the nation’s largest sub-prime mortgage lender, did not admit to any wrongdoing as part of its settlement but agreed to reform several of its business practices.

The changes include providing borrowers with full disclosures on the terms of their loans, ceasing to give its lending agents financial incentives to include higher fees or other penalties on loans, and changing how it handles appraisals.

The company also agreed to submit to independent monitoring for five years.

"Ameriquest caused me the loss of my home. With promises of lower house payment I went from 650 a month to 850. I was suddenly a single mom and trying to make it on one salary. Ameriquest caused me thousands of dollars! $600 would only be the first 2 months!!!! They should be out of business! not still sending me letters about my loan and my ability to qualify for a home equity loan, I don't even have the home anymore!"

"BIG DEAL Ameriquest destroyed homeowners with the promise of helping them out, only to stuff his own pockets. He is the 73rd richest man according to Forbes. He has shot thousands in the foot and the restitutionss are going to be something humiliating like at best $800 per family. This man Arnall will still remain very rich Who can Help ??? Justice where?? NO WAY $6 to$800 per family"

"I'm currently so being screwed by this AMC they haven't changed there pratices since I refied with them and I didn't know about this law suit now that I am tring to straigten it out no one will help because Americquest has closed all it's office's in my Town.

"I was told that I would not have a prepayment Penalty and after my Husband and I signed the papers I noticed that there was a prepayment Penalty for 3 years."

"I had a huge prepayment penalty that lasted long after my mortgage adjusted. They told me it would only adjust to 8% then I found out that is where it started. Where do we sign up??"

"I had a refinance loan with Ameriquest in Feb of 2005 that after I signed paperwork I discovered they had put a prepayment penalty on the loan which they agreed they would not do. I have refinanced to get out of this loan and had to pay massive prepayment fees. I want to know how to get to be a part of this suit?

"Please advise me what to do in order to get involved in the suit. Since our refinance with Ameriquest we discovered that they over appraised our home. What can we do? We are desperate to get as far away from them as possible."

"We would like to know what we need to do in order to perticipate in this suit. Also we just refinanced with Ameriquest Jan 2006. Our rate increased 1% due to errors on my credit report and when i discovered this and asked our broker if the rate could be lowered he said it had all ready been done, so now we are stuck 2yrs paying more money. Is there anything that can be done about this?"
